1. SUBJECT SCOPE

These Terms and Conditions define the rules for the Intermediary to provide intermediary services to the Client in purchasing goods from the Seller.

2. GLOSSARY

Terms used in these Terms and Conditions mean:

  • Client account – an individual account in the electronic system, maintained and managed by the Intermediary,

  • Client – a consumer within the meaning of Art. 22¹ of the Civil Code, on whose behalf and for whose benefit the Intermediary purchases goods from the Seller,

  • Intermediary – the company Lunari Moda, with its registered office at Unit 2A, 17/F Glenealy Tower, No.1 Glenealy Central, Hong Kong, VAT ID: 6821775107, REGON: 367965813.
    (If you want to withdraw from the contract – CONTACT US to learn the return address. Please do not send goods to the registered address – the shipment will not be accepted. The customer service department is not located at the company's registered address.)

  • Registration – the process enabling the creation of an individual client account,

  • Seller – an entity being an entrepreneur, having its registered office in a third country. Data is available HERE,

  • Intermediary service – a service provided by the Intermediary for the Client in accordance with these Terms and Conditions,

  • Consumer Rights Act – the Act of May 30, 2014 on consumer rights (Journal of Laws as amended),

  • VAT – value added tax on goods and services upon import, in accordance with the Act of March 11, 2004 (Journal of Laws 2016.710 consolidated text).

3. SCOPE OF THE INTERMEDIARY SERVICE

The Intermediary places an order with the Seller on behalf of the Client and makes payments related to importing the goods.


4. OBLIGATIONS OF THE PARTIES

Intermediary:

  • provides information about contract withdrawal,

  • handles complaints,

  • is liable under warranty,

  • commits to delivering the goods within 60 days,

  • provides documentation in Polish upon request.


5. USING THE INTERMEDIARY SERVICE

The Client places an order through the website, providing: first name, last name, email, and delivery address. The Client agrees to the service being performed before 14 days elapse and confirms losing the right to withdraw after the service is performed.


6. REGISTRATION AND LOGIN

Registration is free. The Client provides personal data and sets a password. Registration allows placing orders without re-entering data.


7. DELIVERY OF GOODS

The goods are delivered by the Seller within 60 days. The Client is the importer and is responsible for customs and tax charges. Non-delivery must be reported within 100 days.


8. PAYMENTS

  • Payment for the service and delivery costs (excluding customs duty and VAT) is made in advance.

  • Available payment methods: bank transfer, PayU, PayLane, payment cards, electronic transfers.

  • Payment term: 60 days from placing the order. After this period – the order is canceled.


9. RETURN OF GOODS

The client has the right to return the goods within 14 days. The goods must be sent back to the Seller's address. The return shipping costs are borne by the Client. The statement can be submitted electronically using the return form.


10. COMPLAINTS

The intermediary handles complaints related to:

  • goods (warranty),

  • operation of the website,

  • intermediation service.

Response time: up to 14 days. Payment complaints are reported to payment operators.


11. PERSONAL DATA PROCESSING

Data is processed in accordance with the Act of May 10, 2018. The Client has the right to access, correct, and delete data.


12. COPYRIGHT

Content and materials on the website are the property of Lunari Moda or licensors. Copying and use without consent is prohibited.


13. TECHNICAL REQUIREMENTS

Using the website requires a device with Internet access and enabled cookies.


14. CHANGES TO THE REGULATIONS

Changes to the regulations are published on the website with a 14-day notice. Using the service after changes means acceptance.


15. FINAL PROVISIONS

  • The regulations are available free of charge online.

  • Communication with the Client takes place via e-mail: info@lunarimoda.com

  • The regulations are effective from the moment of publication.

  • The applicable law is Polish law.

  • Disputes will be resolved amicably or by the court with local and subject-matter jurisdiction.
